Postponement of health and safety reviews

177/2020 issued for the emergency period. (V. 4.) Government decree provides as follows on the postponement of certain periodical reviews for occupational safety purposes, on the extension of the medical validity of operator licenses required for work, and on the postponement of certain periodical reviews

 Postponement of periodic reviews for occupational safety purposes and extension of the medical validity of operator licenses required for work

After the end of the emergency It can be postponed for up to 60 days from periodic reviews for occupational safety purposes

a) XCIII of 1993 on labor protection. defined in Section 23 (1) of the Act periodic safety review of dangerous work equipment,

b) 10/2016 on the minimum level of safety and health requirements for work tools and their use. (IV. 5.) NGM Decree (hereinafter: NGM Decree 10/2016) defined in Section 17 and Section 18 (1) periodic control review of non-hazardous work tools

c) in the case of electrical equipment, 10/2016. NGM decree

ca) mechanic inspection according to § 19, paragraph (2),

cb) standardization review according to § 19, paragraph (3),

cc) periodic control review by mechanic inspection according to § 19, paragraph (6),

cd) periodic control review with standardization review according to § 19, paragraph (7),

d) it is  Forklift Safety Regulations 47/1999 on its publication. (VIII. 4.) GM decree Appendix Chapter I 7.2.7. according to point lifting machine structural and main inspection,

e) a  Welding Safety Regulations 143/2004 on its publication. (XII. 22.) GKM decree Appendix 8.1. according to point periodic inspection of welding equipment and safety fittings.

Expiring during the emergency, during work the medical validity of the driver's licenses required to perform certain activities is extended to 60 days after the end of the emergency.

On the different application of regulations related to the obligation of periodic review and maintenance of certain technical equipment, devices, and structures during emergency situations

During the state of emergency - if their implementation is disproportionately difficult due to the circumstances arising in connection with the existing state of emergency - the National Fire Protection Regulations No. 54/2014. (XII. 5.) BM decree The periodic review and maintenance of the technical solutions specified in Table 1 contained in Annex 18 does not have to be carried out.

In the case of application of the above, operator inspections – if the legislation specifies a longer time for its implementation – must be carried out at least once a month.

The above-mentioned reliefs are valid during the state of emergency they do not apply to the legally defined obligation related to the prevention, repair, and continuous readiness of the affected technical equipment, device, or structure.

The person obliged to carry out the missed periodical review and maintenance must take action within 30 days after the end of the dangerous situation - documented in a certified manner.
