What is a Risk Assessment?

Risk assessment means examining and auditing a workplace, work process and the tools used for work.

 

Carrying out the risk assessment is considered an occupational safety and occupational health professional activity, which the employer can have carried out by an authorized occupational safety and occupational health specialist employed in accordance with the Occupational Safety and Health Act. The risk assessment must be prepared together with the occupational health service provider and the occupational safety specialist and authenticated with their signature.

 

The employer is obliged to carry out risk assessment, risk management and preventive measures in accordance with the provisions of the Occupational Safety and Health Act before the start of the activity, and thereafter in justified cases, but at least every 3 years. Justified cases include a change in the activity, technology, work equipment or working method used, as well as any changes that affect the working conditions that determine the health and safety of employees. This includes factors such as the working climate, noise, vibration, changes in air conditions (changes in the quality or quantity of gaseous, dust, fiber air pollutants), as well as the occurrence of work accidents, increased exposure or occupational diseases resulting from deficiencies related to the applied activity. In addition, the risk assessment is also justified if it covers aspects defined in separate legislation.

Risk assessment and documentation

The risk assessment must be documented in all cases, even if the experts come to the conclusion that the measures used guarantee safe working conditions that do not endanger the health of the employees.

 

The formal requirements of the risk assessment documentation are not strictly prescribed, but in terms of content, at least the following must be recorded:

  • Date, place and subject of risk assessment.
  • Identification data of the evaluation specialists.
  • The identified hazards.
  • Identification of those at risk and affected, as well as the number of affected persons.
  • Factors aggravating the risk.
  • Qualitative or quantitative assessment of risks and determination of whether the conditions comply with the rules on occupational safety and whether risks are kept at an acceptable level.
  • Indication of the necessary preventive measures, deadline and responsible persons.
  • The next scheduled date of the risk assessment.
  • The date of the previous risk assessment.

 

The employer must keep the document for at least 5 years. In addition, the employer must ensure that the results of the risk assessment are known to the employees and that they can access the document at any time.

Home office legislation

Carrying out a risk assessment of the home office is both an occupational safety and labor law obligation on the part of employers. The labor law rules for teleworking are governed by Act I of 2012 on the Labor Code, while the labor protection rules are regulated by Act XCIII of 1993 on Occupational Safety. contained in the law.

The provisions of these two laws must be applied taking into account the peculiarities of working at home. It is the employer's responsibility to create safe and health-free working conditions even in the case of remote work (home office), so the Occupational Safety and Health Act imposes occupational safety obligations on the employer with regard to working at home. The main point of this is the work, and the risk assessment, which confirms the conditions of safe work, prior to the modification of the employment contract. (Ref.: Mvt. § 86/A. paragraph (3).)
