Information about the amendment of occupational health and safety rules related to teleworking

Government Decree 487/2020 (XI.11.) was published in Magyar Közlöny No. 244 (November 11, 2020), which deals with, among other things, the application of rules related to remote work during the emergency. Using the emergency authorization given due to the second wave of the Covid-SARS 2 coronavirus, the government took the following measures:

  1. § (1) XCIII of 1993 on labor protection. on the different application of the provisions of the Act § 1. (1) 478/2020 on the declaration of a state of emergency. (XI. 3.) During the state of emergency (hereinafter: state of emergency) declared by government decree, XCIII of 1993 on labor protection. Act 86/A. § shall not be applied.

Based on the issued provision, this means that during the declared state of emergency, the XCIII of 1993. law (Employers are exempted from performing the risk assessment tasks and obligations contained in § 86/A of the Occupational Safety and Health Act and defined in § 54 of the law.

However, we would like to draw the attention of our Partners to the fact that after the end of the emergency, this obligation is automatically restored, regardless of when the employee started teleworking (retroactive effect)!

§ 1 (2) In the case of remote work, the employer informs the employee of the rules for working conditions that do not endanger health and are safe, and the employee chooses the place of work taking into account the fulfillment of these working conditions.

As an aid in the implementation of paragraph (2), we recommend sharing informational video material made by the employees of Cedit 2000 Kft to their employees. The video shows the minimum requirements for a workstation suitable for working at home.
