Home office legislation

Carrying out a home office risk assessment is both an occupational safety and health obligation on the part of employers. The labor law rules for teleworking are regulated by Act I of 2012 on the Labor Code, while the labor protection rules are regulated by Act XCIII of 1993 on Labor Protection. law.

The provisions of these two laws must be applied taking into account the specifics of working from home. Creating the conditions for work that does not endanger health and is safe is also the responsibility of the employer in the case of telework (home office), so the Labor Protection Act imposes occupational safety obligations on the employer with regard to working from home. The main moment of this is the risk assessment prior to the amendment of the work or the employment contract, certifying the conditions of safe work. (Ref .: Section 86 / A (3) of the Mvt.)
