In 2020, the subject and operation of official inspections is expected to be as follows:

  1. Subject: Target inspection of construction industry execution activities

Purpose: The inspection of the construction industry is justified by the fact that, based on the authority's records, in the period prior to the issuance of the inspection plan (in 2018), the proportion of serious work accidents due to irregular work was the highest in the sector. Quantitatively, there were 28 serious and 22 fatal work accidents.

Inspection period: 2020. II.-III. quarter

  • Subject: Self-initiated target investigation

Target inspection of activities, professions or sectors selected by the authority conducting occupational safety inspections based on the economic structure of their area of competence, the situation of occupational accidents and their inspection experience.

Purpose: Examined sources of danger affecting employees.

Inspection period: the period designated by county in 2020

According to the type of official inspections, they can be targeted inspections, action inspections, complex inspections and pre-announced inspections.

A target inspection is an inspection that is aimed at a specific inspection purpose (e.g. an inspection of the legality of employment from a labor or occupational safety aspect of an activity in a sector of the national economy) and does not cover all the inspection subjects listed in Section 81 (4) of the Mvt. Regarding its method, it typically lasts at least three weeks and most of the government officials performing the inspections participate in the inspections.

A complex inspection is an inspection that includes a full examination of the general work safety duties of employers according to the guidelines of the organizational units responsible for the professional management of the Ministry of Finance.

The pre-announced inspection is an on-site inspection based on notification one month before the inspection.

An official investigation is also initiated in the event of a report or complaint in the public interest, which must cover all issues within the jurisdiction of the authority conducting occupational health and safety inspections.

The means of inspection are the on-site inspection and document inspection, which in this case covers the inspection of occupational safety documentation (e.g. risk assessment, protective equipment benefit schedule, medical examination schedule, etc.).

Due to changes, extraordinary events or circumstances affecting occupational health and safety (e.g. increase in serious accidents at work, changes in legislation, etc.), the minister responsible for employment policy may order an extraordinary action inspection in addition to the inspection plan.

Based on § 82 of the Mvt., the occupational health and safety authority applies an occupational health and safety fine against an employer who fails to meet the requirements for safe and non-health-threatening work, thereby seriously endangering the life, physical integrity or health of the employee.

The amount of the labor protection fine can range from HUF 50,000 to HUF 10,000,000.
